Because they receive federal funding from the US Government, Public Schools are in most states, protected from liability by what is called “Sovereign Immunity”. This means that public schools either have monetary damage caps or are completely immune from being sued through normal civil lawsuits based upon negligence and other state law claims. Herman Law, however, has successfully, and routinely, found a way to avoid sovereign immunity and sue public schools with no immunity or caps on damages. This is through lawsuits based upon Title IX.
Title IX is a federal gender discrimination law that Herman Law has used to avoid sovereign immunity when suing public schools. In fact, Herman Law paved the way for how to successfully use Title IX in sexual abuse cases against public schools. The preeminent and often cited case that set forth the legal standard for a successful sexual abuse claim against a public school based upon Title IX was won by Herman Law.
