A Parent’s Worst Nightmare.
Child care, whether in a Preschool, Day Care of After Care program, is an essential and often necessary service that parents must rely upon for the supervision, safety and development of their children. In order to ensure that their children are cared for properly at all times, parents often have no choice but to put their trust in a child care facility to provide a safe and healthy environment for their children. Unfortunately, it is all too common to see a child care facility cut corners or act with sloppiness and ignorance when it comes to putting safety first and supervising the children entrusted to its care. In some cases, the child care facility will fail to conduct a proper background investigation on its employees, hiring them to work with children when in fact, they are sexual predators. Sometimes, even when proper background checks are conducted, the child care facility will fail to recognize red flags that should alert them that certain employees pose a danger to children. In addition, child care facilities must have safe policies and procedures to prevent inappropriate touching. In other cases, the day care accepts a child with behavioral problems it knows will create a risk to the other children.
Our attorneys have successfully handled cases against day care facilities by bringing legal claims for negligent hiring, retention and supervision arising from the sexual abuse of children entrusted to its care.
