Child Victims Act

If you were sexually abused as a child, you now have the right to bring a claim and be compensated, regardless of how old you are or how long ago it happened.

Start the Healing Process

The recent Child Victims Act eliminates the statute of limitations for child sexual abuse crimes. That means sexual abuse survivors of any age may still sue for financial compensation in civil court.

Important Note: The new law provides a one-year window for past abuse victims to file one-time-only civil claims, so please don’t delay.

New York has had one of the strictest statute of limitations for child sexual abuse claims in the country. The law in place for child sexual abuse victims allowed them to report the crime to law enforcement officials and have the crime prosecuted until the age of 23. After that age, the abuser had a complete defense and was able to avoid prosecution entirely.

Because of the close proximity of the abusers and the difficulty in reporting sexual abuse, survivors typically do not speak out until adulthood, leaving many without recourse. The Child Victims Act recognizes this delayed reporting reality and extends the statute of limitations on child sexual abuse crimes to the age of 28 in criminal cases and the age of 50 in civil cases. The bill also provides a one year-window to bring civil claims for victims regardless of how old they are or how long ago it happened.
