Change to New York Sex-Abuse Laws Expected to Spur A Wave of Lawsuits

NEW YORK (The Wall Street Journal) Just before Stephen Erickson died of cancer late last year, he got permission from a judge to speak under oath about a school janitor who he said sexually abused him beginning in seventh grade. “Over and over again,” Mr. Erickson, 55 years old, said from his hospital bed in Albany, N.Y. Mr. Erickson gave his deposition in anticipation of the passage of the Child Victims Act, a state law extending the time for victims to file lawsuits against their abusers and the institutions that employed them. His deposition was one of many preparations for […]

Survivors of Sexual Abuse Plan to File Lawsuits August 14th

NEW YORK (WRVO) Beginning August 14, New Yorkers who are survivors of childhood sexual abuse will have a one year window of opportunity to file civil suits against their abusers, under the terms of the Child Victims Act passed by the legislature earlier this year. Thousands of cases are expected to be filed, with payouts potentially in the millions.  Gordon Smith was 14 years old when he says he was first abused by two priests at a St. Patrick’s Catholic Church and school in Albany in the early 1960s. He was filling in as a janitor for his father, who […]

Lawyer for Abuse Victims Demands New York Archdiocese Release ‘Predator Priest’ Data

NEW YORK (NEW YORK POST) A lawyer representing childhood victims of alleged sex abuse on Monday demanded the Archdioceses of New York release “secret files” on “predator priests” — before a one-year statute of limitations rule expires. “We’re launching a petition today to demand that the Church of New York, all the Catholic Dioceses, release their secret files that contain important information on predator priests,” said Jeff Herman, an attorney representing the victims in a class action lawsuit against the archdiocese. In the yet-to-be released documents, more than 500 priests have been identified as child abusers, Herman said. “That’s the […]

Victims Should Not Be Fooled By the Buffalo Diocese Compensation Program

It is reported today that the Diocese of Buffalo paid $17.5 to 106 clergy abuse victims under its “voluntary” compensation program.  Bishop Richard Malone is quoted as stating “We’re doing this now because I know it’s the right thing to do.”  As a lawyer representing hundreds of clergy abuse victims, I do not believe the Diocese is acting out of concern for the victims.  I believe the voluntary compensation victim program was put into place to settle claims for pennies on the dollar before the New York Child Victims Act became law.  I hear from many victims who feel re-victimized […]

Woman Accuses Former Salvation Army Lieutenant Of Sex Abuse

NEW YORK (WCBS 880) — A former high-ranking officer in the Salvation Army has been accused of sexually assaulting his adopted daughter for years in the 1990s. Nicole Sprout says the abuse began at age 11 after her mentally ill mother was unable to care for her and sent her to Lieutenant Gary Crowell and his wife Carol Beth, commanding officers of the Salvation Army Corps in East Northport. “I was 13 to 16-years-old when full sexual contact and intercourse occurred,” Sprout said Tuesday in front of the Salvation Army headquarters in Manhattan. When the abuse became public, the couple […]

Texas Lawmakers Consider Extending Statute Of Limitations On Child Sex Abuse Cases

According to CBS Dallas, a Dallas-based attorney who represents survivors of sexual abuse believes the investigation of alleged sex abuse by clergy shows why statewide, the statute of limitations needs to be extended for child victims. One piece of legislation could make that happen. “I represent a number of survivors of clergy abuse in the Catholic Church,” attorney Michelle Simpson Tuegel said. She said most of these clients are in their 50s and 60s, waiting decades to talk about what happened to them and seek justice. The statute of limitations for child sex abuse would start counting the years […]
