New York Child Victims Act

The New York Child Victims Act makes a necessary change to long standing precedent in statutes of limitations in child sexual assault cases. New York Governor Andrew Cuomo has made this Act one of his top initiatives for 2018-19, and after the Legislature voted to approve the legislation on Monday Jan 28th,2019, it now heads to the Governor’s desk for his signature.

The Child Victims Act will extend the statute of limitations on child sexual abuse crimes to the age of 28 in criminal cases and the age of 50 in civil cases, with a one year-window to bring civil claims for victims below that age limit.

Charter School Sued for Child-on-Child Sexual Assault in a Kindergarten Class

  WHAT: JEFF HERMAN (www.hermanlaw.com), a nationally-recognized attorney for victims of sexual abuse in schools and daycare centers, announces the filing of a lawsuit against Citizens of the World Charter Schools (located in Brooklyn, NY) for failing to protect a student from sexual assaults by a classmate.

According to the Complaint:

  • A male kindergarten student stuck his hands down the pants of a five-year old kindergarten girl. 
  • The little girl told her mother who immediately went to the school and advised the principal of the assault.
  • The principal promised to protect the girl from further harm. 
  • Despite the school’s promises, the boy continued to sexually assault the girl at school.
