Victims of child sex abuse  by the Boy Scouts of America now have a November deadline to file claims. “At a time when millions of Americans are unemployed and preoccupied with basic survival, sexual abuse survivors need and are entitled to a reasonable period of time after they receive notice from the bankruptcy Court to reflect seriously and make a decision whether to file a claim in this case,” representatives for  victims committee wrote in a court filing.  Boy Scouts have filed for bankruptcy and had initially proposed a deadline of 80 days after notice of the claims process […]

Thousands of Child Abuse allegations force Boy Scouts of America to file for Bankruptcy

Declining membership and several sexual abuse allegations are the reason the Boy Scouts of America filed for bankruptcy protection just a few weeks ago. The depth of the problem within the Boy Scouts and the failure to handle any allegations is the main reason they filed for Chapter 11 in U.S. Bankruptcy Court in Delaware.  The future of Boy Scouts is still unknown and some speculate that the impact on local troops and the organization will be so negative that some fear that it will prevent survivors from naming their abusers in court.  There are still many survivors that […]

Flood Of Child Sex Abuse Lawsuits Expected To Hit NY Next Week

NEW YORK (WNYC/Gothamist) Next Wednesday, adult survivors of child sex abuse in New York will begin filing a flood of civil lawsuits against institutions and individuals, after decades of having their cases barred from court because the allegations were too old. Hundreds of plaintiffs are expected to sue organizations large and small, including Catholic dioceses and parishes, the Boy Scouts of America, hospitals and educational institutions. The one year window was enacted under the Child Victims Act that lawmakers passed in January, and intended as a partial remedy to the state’s previous statute of limitations, which required victims to bring civil cases […]

The New York Child Victims Act is now law.  It is great news for victims but it also creates many new issues for these same people.  Prior to passage of the CVA, victims had to file their civil cases before they turned 23 years old.  Of course, most survivors of child sexual abuse did not meet this overly restrictive deadline.  Having no legal recourse, many victims have spent decades trying to move on and suppress these memories.  Now seemingly overnight, anyone who was sexually abused as a child in New York and the ability to file a civil lawsuit and […]
